I have no doubts that you are absolutely right ya phylay. And whatever 'legal rights' the U.S. administration obtains, it will probably be the case that once the issue is resolved in its favor there will be implications to what it can do with the information it obtains and it will have an execellent mass surveillance resource available for all kinds of purposes.

In a lawsuit brought by the Federal Trade Commission, a subpoena is sent to Google for the complete contents of a Gmail account, including deleted e-mail messages. This is unrelated to the Department of Justice's own subpoena to Google for search terms and excerpts from its search database....

A federal judge has ordered internet search engine Google to turn over some search data, including 50,000 web addresses, to the US government.
However, Judge James Ware denied a request that Google hand over a list of people's search requests...
